New Sexual Misconduct Laws & the Fire Service

Changes have been made to the law that govern sexual misconduct and disclosure (WAC 246-16-100).  During the 2019 legislative session, the Legislature passed HB 1198. This bill requires a health care provider who is subject to the Uniform Disciplinary Act and has been sanctioned by the Secretary for sexual misconduct to provide for the duration of the stipulation or order, a disclosure to every patient at the patient's next visit with the provider.

Qualifying Drivers

An important recurring question from members relates to qualifying a driver and setting a driver qualification policy.

Enduris members have various qualifying needs.  Some drivers must be eligible to drive heavy equipment, while others drive a private passenger vehicle.  A few common elements of qualifying a driver includes: past driving history, responsible driving habits, and training.  While Enduris does not pro-actively qualify drivers, Enduris does strongly recommend that our members establish a written policy relating to driver eligibility.

What do you do when a firefighter has an injury? Here are some steps to take after the injury has occurred:

  • ·         Firefighter promptly reports injury to Chief, officer or human resource department to start the return to work process. L&I or self insurance claim is generated and accident report form is filled out using lni.wa.gov/filefast or by department policy. A claim number is usually generated.
  • ·         Chief or Officer sends firefighter to health care provider with a return to work package. This usually includes the department’s SOG or SOP with return to work instructions, Job Analysis and Job Description forms for both Full and Light Duty....
