FMCSA Extension & Resources

Updates on COVID-19 Waivers, NEDDs and other FAQs

Members,

Yesterday evening, the Federal Motor Carriers Safety Administration (FMCSA) announced an extension of Emergency Declaration No. 2020-02, providing regulatory relief related to COVID-19, set to expire May 31, 2021.

According to the ATA, Motor carriers should read the latest extended Emergency Declaration carefully. In previous versions, the declaration had been narrowed significantly in scope and now includes a category for food, paper products, and grocery store restocking if it falls under the category of “direct assistance goods.”

The extension of HOS relief now applies to certain categories of COVID-19 relief operations for drivers transporting:
  1. Livestock and livestock feed;
  2. Medical supplies and equipment related to the testing, diagnosis, and treatment of COVID-19
  3. Vaccines, constituent products, and medical supplies and equipment, including ancillary supplies/kits for the administration of vaccines, related to the prevention of COVID-19;
  4. Supplies and equipment necessary for community safety, sanitation, and prevention of community transmission of COVID-19 such as masks, gloves, hand sanitizer, soap, and disinfectants; and,
  5. Food, paper products, and other groceries for emergency restocking of distribution centers or stores.

Direct assistance does not include routine commercial deliveries, including mixed loads with a nominal quantity of qualifying emergency relief added to obtain the benefits of this emergency declaration. The LMTA encourages members to review the extended declaration to determine if their operations are included. Please note, this expanded declaration becomes effective at 12:00 a.m. June 1st, and expires on August 31st, 2021.
