Canton (OH) to Pay $350K to Settle Lawsuit Involving Fatal Fire Apparatus Accident

Canton (OH) has reached a $350,000 settlement in a lawsuit stemming from a fatal auto crash involving a fire truck.
Dale Burlingame was killed and his wife, Grace, seriously injured in the crash about nine years ago on Cleveland Avenue NW. The legal saga has spanned numerous legal challenges and disputes, bouncing from Stark County Common Pleas Court to the 5th District Court of Appeals to the Ohio Supreme Court and back to the trial court.

Canton City Council approved the mediated settlement on first reading Monday night; for payments to take effect, the agreement must be finalized by Stark County Probate Court.

In July 2007, Dale and Grace Burlingame had just celebrated their 53rd wedding anniversary, when Dale turned their van onto Cleveland Avenue NW from 18th Street and it was struck by a firetruck. The firefighter who drove the truck said in a deposition and during the case that he thought the traffic light was green, according to the city law department. The truck's siren wasn't working but the driver used the air-horn to alert motorists and the emergency lights were activated, according to the city.

Grace and her husband's estate sued the city in 2009.

Man Hits Augusta (GA) Fire Apparatus, Dies Instantly

A man was killed after striking a fire truck Tuesday on Mike Padgett Highway. The Richmond County Sheriff's Office and Augusta Fire Department were working a wreck with injuries around 2 p.m., when a vehicle failed to slow down for the wreck and struck the non-moving fire engine on Mike Padgett Highway near Horseshoe Road.
Richmond County Coroner Mark Bowen said Collins, of Clark Road, hit the rear of the fire truck and died instantly. He was pronounced dead at 2:10 p.m.

Collins was driving a Ford Escape and had to be extricated from the vehicle. Emergency equipment on the fire truck was flashing, Bowen confirmed.

Strongsville (OH) Awards Fire Station Renovation Contract

A Broadview Heights firm has won a contract to renovate Strongsville's Albion Road fire station, one of four fire stations in the city.

The city will pay Seitz Builders Inc. $586,900. The company submitted the lowest of six bids, the highest of which was $842,780. The other four bids ranged from $611,700 to $729,000.

Building Commissioner Tony Biondillo said that since Seitz's bid was under budget, the renovation will include several additional items listed as alternates in the bid documents. The alternates include fiberglass windows, millwork, furniture, sidewalk and brick repairs and LED lights. Seitz will also paint the station's bay rooms.

The main work will include redesigning restrooms to make accommodations for women firefighters, although the city now employs only men firefighters; upgrading the heating, ventilating and air-conditioning system and adding insulation; and replacing the roof. The project will also include buying a new backup generator and replacing a light pole and fixture at the station's front entrance.
